    Fit Note Policies in the UK: 2026 Changes That Count

    If you have ever been signed off work by your GP, you will likely be familiar with the document officially known as the 'fit note' – or, more formally, the Statement of Fitness for Work (Med3 form).


    As of May 2026, the UK government has officially recognised the current system as "broken" and has launched significant pilots to transform how sickness absence is managed.


    If you are an employee trying to work through time off or an employer trying to help your team, this is what you need to know about the current state of the fit-to-work medical certificate and the evolving policy environment.


    Moving Beyond the "Not Fit for Work" Note


    Historically, the Statement of Fitness for Work (the official name for a fit note) has functioned primarily as a binary tool: it either says you are "not fit for work" or "may be fit for work.


    The recent government findings revealed that almost all fit notes were issued as "not fit for work." As a result, employees and employers alike found it complicated to set a clear-cut recovery or reintegration plan. The new 2026 reforms aim to change this situation by:


    Introducing Personalised Plans: New pilots in selected regions are moving away from simple certification. New approaches to “workability plans” now link patients with community health teams to focus on what they can do, rather than what they can’t.


    The 7-Day Rule: You do not need a fit note if you are off work for 7 calendar days or less. During this time, you can "self-certify" your illness. If you are off for more than 7 days, your employer can legally request a fit note as evidence.


    Encouraging Earlier Intervention: The goal is to keep employees connected to their workplace from day one, rather than allowing the fit note process to lead to isolation.


    Reducing Administrative Burden: With many healthcare professionals noting that fit notes are not the best use of GP time, these trials explore how non-clinical and clinical practitioners can better support employees in returning to work.


    Digital Fit Notes: For individuals leading a busy schedule, the waiting days for in-person appointments can add unnecessary stress. The UK Government now identifies digital fit notes as a legitimate medical document. By leveraging telehealthcare platforms, employees can access consultations more efficiently and ensure that they receive professional medical advice exactly when they need it.


    Who Can Authorise a Fit Note in the UK


    Remember that it’s not just GPs who can issue these notes. Nurses, occupational therapists, pharmacists, and physiotherapists are all authorised to provide fit notes, which can often lead to a more specialised assessment of your condition. Digital Flexibility: Whether you visit a physical surgery or use a digital fit note provider, the legal validity of the certificate is the same, provided it is issued by an authorised healthcare professional.


    Special Rule: Long-Running Absences Before September 2025


    The DWP introduced an additional protection specifically for employees who had been continuously absent for a very long time before the legislation changed. An employee who, on 6 April 2026, had a continuous sickness absence starting before 22 September 2025 — meaning they had stopped working and received no pay throughout- will technically be eligible for SSP, but their rate will be £0 per week.


    However, if they returned to work on or after 22 September 2025 but later resumed their sickness absence as part of a linked period within 8 weeks, then they will be eligible for SSP with pay. This provision is designed to avoid a situation where someone who has been on extended long-term sick leave suddenly becomes eligible for SSP payments that were never anticipated when they began their absence.


    What This Means for Employers


    Employers must review and upgrade the company's policy on sickness absence according to the new SSP guidelines. With significant effects on the payroll system, clear communication is necessary throughout the administrative and management teams and staff.


    Employers must ensure accurate sickness tracking and absence management systems are in place following the transition. The Employment Rights Act 2025 also sees the establishment of the Fair Work Agency (FWA), a new enforcement body.


    Once operational, the FWA will have powers to enforce SSP payments. Fit notes remain central to this process. An employer may request a fit note — the fit-to-work medical certificate — as evidence before authorising SSP payments, particularly for absences that extend beyond seven days. Accurate documentation helps both parties navigate any transitional periods clearly.


    What This Means for Employees


    If you were on sick leave and receiving SSP before 6 April 2026 and your illness has continued, the transitional arrangements are likely working in your favour by maintaining your previous rate of pay. Your fit note documentation plays a key role in keeping that period of absence continuous and correctly recorded.


    The document is emailed to you so you can redirect it to your HR or Manager. This system is especially relevant for patients managing long-term or recurring conditions, where digital access to fit notes through an online or telehealth consultation removes a significant practical barrier to maintaining continuous documentation.


    Keeping Your Absence Continuous: A Practical Note to Fitness and Productivity


    Any return to work — even a brief one — can break the chain and move the employee onto the new SSP calculation going forward. Before returning to work after a long-term sick leave, employees should seek clarity from their GP or healthcare provider and ideally confirm the implications with their employer or HR team. If a "may be fit for work" recommendation is given, the phased return plan should be documented carefully to avoid any inadvertent interruption to the protected period.
